Asked by Cmichaels, 45044 Wed Apr 28, 2010

I have a family member who I wrote a lease for to rent my property even though it was for proof of where she resides so her kids could go to school I have asked to her move she has a guy living there and the children are running wild through the neighborhood..the electric is in her fathers name and the water and gas is in hers. Since the electric is in her dads and he is not on the lease and I turn off the service to due his presents not being there?

CMichaels,
You need to consult with a competent real estate attorney before making any rash decisions, noone on here is going to be able to give you sound advice on what you want to do. It seems like you have a mess on your hands noone here has a copy of the lease there are too many what if's to answer your question, contact legal counsel and best of luck

I agree with Kent. What does your lease stipulate? Don't assume -get legal advice.

Cmichaels STOP----SLOW DOWN
You need to do an eviction to get her out of the property. The courts in Ohio are property owner friendly until you start to do a "self help eviction". If you do not know the procedure to do an eviction or can not take the time off work to file the paperwork and go to court you need to contact an attorney. By the way if the utilities were in your name and you called the utility company they would tell you that you turn off the utilities but they would not advise you of the repurcusions.

here is a link to the Ohio Revised Code about the utility issue.
