BF kicked (presumably EX) girlfriend out - tenant rights?

Asked by Trulia Naples, Naples, FL Tue Dec 18, 2012

A boyfriend kicked his girlfriend out of their shared apartment. She is not on the lease but all of her stuff is there, her mail gets delivered there and she was paying a monthly rent. Unfortunately, things got ugly and he has changed the locks.

Does she have any rights? She feels that she should be considered a subtenant. Should she contact police or a lawyer?

Who is on the lease? Is there any other lease - sublease or signed papers? If not I don't know what grounds one would have for being able to remain, but you could ask a lawyer to see if they will give an answer.

Wow, this is definitely a legal question. Once she learns her legal rights, it will still probably be necessary to contact the police to escort her to the premises to reclaim her property, but I would have someone else set up that arrangement, if at all possible. Better safe than sorry.
