I bought a "condo" and 38 yrs later they are considered by the association as PUD's Is this lawfully correct?

The definition of a PUD is "Planned Unit Development". A condo can be considered the same thing.

If it is a PUD, then you own the land. I would check into it a little further by checking to see if the land was deeded over to you.
