My wife and I bought a house in york, pa a little over two years ago and we have just had major basement

flooding. As we removed damaged carpet, walls and personal items we have found cranks in slab that has allowed it to flood. We also see signs of past repairs that have failed. Do we have any options since the sellers disclosure says they never had water damage?

Jeffrey asks valid questions. Diving a little deeper, your neighbors may have experienced flooding as well, since nothing has occurred in your home over a 2 year period. As neighbors always know what's going on, they'll surely provide the insight you need to answer the time, money, culpability questions that Jeffrey mentioned. You might also search for how/where the flood water got inside to determine frequency and again, culpability for your damages? Hope you are dry now!?

Curious as to why no one seems to have answered your question yet? Lots of liability in any responses. That said, there are a number of questions you have to ask yourself before attempting to go after someone.

1. First and foremost, is the previous damage significant enough to warrant the expense of suing someone, let alone the headache and time sink.
2. Do you think it's easy for a third party to discern that previous damage existed that was not disclosed?
3. Do you think that third party can determine when the damage occured, such that it can be attributed to a specific owner?

There's not enough detail in your question to really answer it. For example, was the previous owner the only owner of the home? If so, then question #3 above is a moot issue.

If you have more info, let me know. But you might not get a lot of answers simply because lots of people in real estate don't want to have to deal with this issue.
