What financial responsibilities do builders have when using irrigation water paid for by HOA?

We live in a 50 subdivision (74 units) where the builder is still building homes and has not transferred management of the HOA to our community. Outside contractors that manage community irrigation and landscaping also do work for the builder, adding new lawns and irrigation. The builder manages two accounts; the builder account and the HOA account; having complete control of HOA expenditures. The builder usually has 3 unsold (completed with certificate of occupancy) that are watered every day. This expense comes out of HOA account (one meter for subdivision), yet the builder does not pay monthly dues for units owned. HOA pays all irrigation charges for new units. Is this legal? Should the builder not be responsible for these water charges as they own these units?
