Property I closed on in August 2011--transfer of deed still not recorded. Anyone know how I can get this resolved?

Asked by Tupper, Chicago, IL Mon Mar 5, 2012

Seller's attorney never got a Water Cert, so money was kept in escrow until he got it. He finally got it, but now Chicago Title is telling me that 2 Water Certs are needed, and they are "working" with Chicago's Water Dept to get the second one. They are taking far too long and I am growing weary. My useless attorney stopped caring a long time ago. What can I do here? Can I not seek damages? Can Chicago Title get away with this?

This sounds very frustrating. I would really call another attorney to help you out on this.

Get the name and number of the responsible party at Chicago Title and keep on pressing them until this issue is resolved.

Hello! If you are not interested in hiring another attorney I would recommend calling Chicago title and asking for a manager, ask for their procedures so that you have a realistic time frame. Call the manager back every few days until the situation is complete to your satisfaction!

In the future use Don Kiolbassa as a lawyer. He's a CPA and he would not have let home close without a water certification. He's at 312 7829035 and Dhk@gbataxlaw.com

City attorneys frequently use a service called "Lawyer's Legs" to take care of Water Certs. If the seller's attorney is far away from the city, be sure she (or he) is aware of this service. Could speed things up!

Good luck, sorry to hear about the frustration!
