My Aunt passed away and did not leave a will. she has a co-op and many accounts.where do I start?

Asked by Rafaela, 11234 Sun Feb 22, 2009

She has owned the co-op for 41 years. She has IRA, Savings and Other accounts. My mother was beneficiary to one of her accounts. Mom recently passed away. I just found out someone is living in her co-op and has a lease for it. We (the family) are not allowed in as of yet. Someone please help.

Hello, your best bet is to find an attorney to help you. The attorney will know the laws to know who would be next in line to the property. Also the attorney can help you with the tenant situation as well.

I hope this answer helped you.

Hi, Rafaela,
New York Law is if you die without a will
all your inheritance goes to next of kin.
Which is a spouse, a child or grandchild, sibling, then it
goes to nieces and nephews.
Your aunt's estate has to pay taxes, so you will
have to go to a CPA accountant . Also, if there is a great
amount of assets you should go to an attorney
this might involve probate court.
and, oh, yes, the property cannot be sold until you seek
a real estate attorney's services.

Good Luck
