It really depends on the lawsuit, and how it affects the marketability of the property. The lawsuit will need to be disclosed.

Hi James, You should talk it over with your broker, but I think it would depend on what the lawsuit is about. Would a buyer want to take on a property with a lawsuit? Probably not. Is is going to prevent or delay closing? Is it going to make your job harder than it's worth?
