Does my new condo have a warranty against construction defects?

Asked by Richard Kollodge, New York, NY Mon Feb 25, 2013

I bought a condo in a new building in Brooklyn a few months ago, and have discovered numerous construction defects, like windows that leak water and fog over, a shower that leaks through the floor, and more. I'm wondering whether buyers of new condos in NYC are protected by warranties mandated by the city or state. Thanks.

Dear Richard:

All new construction is supposed to come with a one year warrantee on material defects or errors in craftsmanship. This would have been written into your contract of sale when you purchased the place. You should discuss this with your attorney who represented you when you purchased the condo. If I can be of further assistance, please let me know.
