Are amendments enforceable if they are not recorded?

If you have amended HOA documents they should be recorded. If there is an argument and everyone is signed I'm guessing that it could be enforceable amongst the parties that signed, but you need an attorney's opinion.

Hi Nina, in real estate there are forms (deeds, quit claim deeds) used to change ownership which are perfectly valid without recording them. However, this is risky because the first to record can supersede an unrecorded claim to ownership. Your question sounds like a legal question and it can best be answered by a real estate attorney.
