You could approach the seller or Realtor and ask if you can write up a back up offer, there always is a possibility that the contract could fall through and your back up offer would be next in line.

Foreclosures posted here are not for sale, at least in most cases. RealtyTrac sells subscriptions to their data, not homes. Most homes in Foreclosure won't appear for sale anytime soon. Some will get worked out, others may get listed as a short sale and some will eventually complete the foreclosure process and either be sold at auction or be listed by the bank and placed for sale. ... more

FYI -- Trulia is not a real estate company. It is a marketing site that pulls listings from many different sources. If it's a listing for sale, then you should address your concerns with the LISTING AGENT.

Also, most Contracts to Buy give the buyer the opportunity to do their own due diligence before closing on a property. If you discover facts about the property during this process that you don't like, then you terminate the contract. Period. No need to get "lawsuit happy". If you discover it's not really on a private beach, then do not move forward with the contract!
