Yes, we can potentially get you approved for a mortgage while you are in a Ch 13 BK payment plan. You'll need to have made at least 1 year of payments, all on time, and also obtain permission from the trustee (permission from the trustee comes after you are pre-approved). The payments on the Ch 13 BK will be included in your debt to income ratio to determine what you can qualify for. Is this a municipal water line? An intact water line should not cause a sidewalk and yard to sink. I believe your first inquiry should be to the municipality to find out who is responsible for her water line crossing your property. It may be crossing your property because the municipality had to have it there. There may even be an easement across your property for the water line - that would be something else you would have to find out. But start with the municipality's water department.... more

This is not legal advice, but has been my experience as a property manager:
First of all, do you have a lease? The lease should state your rights to have the locks changed by you if the tenant changes the locks without permission. Second, you need to file a notice to quit to terminate the residency and start the eviction process and to sue for a money judgment so you can recover the money the tenant owes. Third, the bank will evict the tenant if you are unable to get the keys and get the tenant out before the redemption period.... more
This is not legal advice, but in my experience as a property manager property left behind by tenants can be recovered from the land lord if you pay any fees owed to them. If you were not in the property legally (on a lease) you would have no permission to be on the premises or claim to the personal property left there. The new owners would have the right to assume the personal property is abandoned as no legal occupants were on record as living In the property.... more

I would call some lenders and have them get you pre approved with a loan that fits your needs. Most realtors in the area can help you find a few different lenders to help you with this.
