Some HOAs are made up of residents of the Complex.
You should go there and visit; walk around and talk to people:
What are the fees?
How often have they been increased?
How draconian are the rules and regs?
How hard is it to sell?
What about pets?

You need to file a police report for the Identity Theft issue. Once you get your police report you would then show that to all creditors who you have accounts with but you did not authorize.

As far as the late payments to your lender, it appears that they are late because of your hardship. If you do not pay your mortgage payments or work out a repayment plan than your lender can begin the foreclosure process which is what they are doing.

I assume with the financial hardship you do not have disposable income to pay an attorney for legal representation. I would suggest you meet with a Hud Counselor in your area who can speak with you for FREE and provide some options to get you back on track with your lender. Good luck!
