Great question for an attorney. Rent to owns rarely turn out well for the Renter/buyer. Most never end up completing the purchase. We can't be more helpful other to suggest you speak to an attorney and bring all your documentation and avoid these in the future.

We have lived here since 2007 and have been very happy. I have seen a lot of people move out, but good people have replaced them, and this place has the potential to be an amazing community if people would stop with the fear. Several people moved to places like Gilbert and other areas, and have gotten robbed. There is crime everywhere, but in this community people are out and about which helps reduce crime. You have been given some good responses to your question asked about HOA's. However, I would like to answer your question more directly to the question asked.

Question: What you would look for upon your first initial search, to determine if a home or neighborhood is within an active and involved HOA?

Answer: Homes within a subdivision with a HOA will have a homogenous maintained feel to them block by block. There are neighborhoods without HOA's that will be well maintained, but an occasional home here and there will be an albatross to the subdivision - possibly suppressing values within that neighborhood. An active HOA will address those kind of out of place homes quickly and effectively, helping to maintain neighborhood cohesiveness. Another indication of homes within HOA's would be common areas that all homes share. It may be an entry medium with a monument, green belt areas, parks & pools.

Question: What are the fees associated to buy a home within an active HOA?

Answer: There are a couple factors that will determine each homeowners contribution to live in a neighborhood with an HOA. The amenities within the neighborhood that are regularly maintained and the number of homes within the HOA to share in the costs. For instance, if there are common areas with landscaping to maintain, fees should remain relatively low. If the neighborhood has a swimming pool with additional amenities fees will be higher - again both these will be determined by the number of homes in the HOA. An active HOA should also have a reserve fund, used for maintenance on amenities that is above and beyond standard charges - such as replacing a broken pool pump or replacing a basketball goal in the park.

Question: How often are HOA fees due.

Answer: Each HOA can be different. The fee can be due monthly, quarterly, semi-annually or yearly.

You can do an internet search once you have identified the subdivision you have interest in. Most HOA's have a website under their subdivision name.

Your realtor will be able to help you with any questions you have about a neighborhood being in an HOA, fees associated and how often the fees are due.
