In CA, I am a tenant. We had to leave a rental property 60 days, prior to our lease ending, we have however, paid the full term of the lease. Lease term Oct 31 2016 - Oct 31 2017.
We moved out Aug 31st, 2017.

We hired a "rental listing agent broker", to list the property for rent on the MLS, at the owners permission, so we might recoup some of the rent we paid for the remaining 60 days the property sat vacant. With 25 days left on our term, and rent already paid in full, we need to cancel our listing agent agreement, as we don't want to pay a commission to her, on TOP of our already paid rent, should she bring a tenant to the table in the last hours.
The other issue, the property owner, said he would refuse to look at any new tenant application from this broker, so it's pointless for the real estate listing agent to continue to keep the home on lock box, and list on the mls.
We have given notice to her, but she is saying, we are under contract and can't cancel with her until the end of our rental term, Oct 31st, 2017. This is holding up out security deposit return ($5500).
Can you cancel our listing with the rental listing broker, prior to the end of the term, and prior to our lease with the owner ? Thank you. Ron

There is NO law anywhere in the U.S. that says sellers must pay a buyers broker when they are For Sale By Owner. This is strictly realtor sales tactics which borders on harassment. The truth is buyers do need to have a down payment and their closing costs are expensive (higher than sellers). Sellers will collect a profit from the sale of their home, so realtors believe that sellers "SHOULD" take a percentage of their profit and pay the buyers broker because it would be a financial hardship for the buyer to pay their realtor.

In this day of technology with more sellers able to sell by owner, realtors are getting squeezed and they are coming up with any BS story to get the seller to pay their broker fee - whether it's true or not. Sellers don't need to pay and do have he right to negotiate. The huge risk is that realtor will tell their buyer client a made up BS story that your home is whatever and the buyer needs to move on and buy a different home - one that is NOT for sale by owner (listed with a broker).

Bottom line - Sellers doing For Sale By Owner need to stand their ground and don't be intimidated by these realtor threats. What I would do is if the realtor refuses to negotiate, talk to the buyer and hand him a contact card with your info on it. Another method is talk to the buyer in front of the realtor and say: "I would love for you to visit my home without your realtor and since there is no commission fee, we can both save money and I'm willing to negotiate a deal."

Id tell them not to show it for that time or get a neighbor or relative to check up on them. Realtors have done it to me 4 times. Left the door open. I wouldnt take any chances. My realtor wont do anything about it. Told me i didnt specifically say the door they left open. And they used the bathroom and didnt flush so you would have that sitting in there two weeks. ... more

Did the buyer include any contingencies in the contract? Buyers typically include contingencies which they can use to back out. In your situation, one month is too long. With your next buyer, any contingencies should be no more than 2 weeks total. ... more
