you do not have to wait 7 yrs after foreclosure if the foreclosure happened due to extenuating circumstances beyond your control that effected your income ( such as job loss or reduction in income, it can not be personal reason such as divorce). then the wait is 4 yrs for Fannie Mae for previous foreclsure

You have to prove the extenuating circumstances with a paper trail such as W2 , tax returns etc
If you walked away from the property because the property values had gone down and you did not want it, even though you could afford to make the payments, then it will not work, the guidelines are very strict

A written Seller's Property disclosure IS NOT required but Florida law requires a Seller and her Realtor to disclose significant defects that may not be readily visible to a buyer.

In practice, most Listing Realtors will get the Seller to sign a Property Disclosure statement. Bank owned and investor flip properties may not agree to complete this form.

Your Realtor could have written in your offer that the Seller shall provide the Standard Florida Assn of Realtors Property Disclosure completed and signed within 48 hours of offer acceptance. Of course Banks will not agree to your demands for a written disclosure. Some Investors or even Landlords will strike through the property disclosure form and claim that because they never lived there they do not have to complete the form.

Hi Dtb29, I suggest you interview at least 3 local Realtors. After that, see who you feel more comfortable with and answered ALL your questions. Ask if they are familiar with your neighborhood, what experience do they have, are they just listing your property and will service by themselves or a team, how many listings do they have or can handle, do they answer the phone when you call them or do you always have to leave a message.

My suggestions would be to hire one Realtor to do the job who has less than 5 current listings, as who can honestly handle/focus and service more than that. Again, someone who will answer your call 98% of the time when you need them. Selling your home can be stressful, find someone who makes you feel at ease. Are you looking to buy in the area?

If you are still looking for a Realtor, I would like a chance to meet with you and hopefully get hired by you. Put me to work as I live in Wilton Manors and know zip code 33309.

Anyhow, in reply to Alan, I thought about not paying for a couple months down the line but I wanted to try this modification first. Their first solution was a special forbearance agreement trial period of 3 months which, after signing it, I was informed would put my mortgage into default. I appealed that and kept paying my normal amount on the advice of someone in the executive complaints office as he agreed with me, it was stupid to put a mortgage that is current into default. On Monday I received a letter from the "home preservation specialist" offering a short sale. On Tuesday I received a letter from her telling me there is nothing else she can offer me because "you withdrew your request" for the forbearance agreement. I assume the game is over - for now. I'm filing a complaint with the Consumer Financial Protection Bureau, and sending letters to Obama, governor of Georgia and attorney general of Georgia just to get it off my chest; I already know I won't get any answers or help from any of them. ... more

Can i restate your question to make sure I understand it? The question you are asking is, "can you refinance today at a lower dollar amount or interest rate?" If you are looking to refinance to take advantage of a lower interest rate, there are options for you with an FHA and VA, even if you are upside down. A lot of people are asking if they can refinance for a lower dollar amount because of the declines in value in the market place, that unfortunately is impossible.
