Is this agent licensed by the state?? The bigger issue is every licensed agent has a contract with their brokerage to work as a realtor (independent contractor). The Broker in Charge / Office Manager is LEGALLY RESPONSIBLE for their agent's actions AND the brokerage does NOT allow verbal listings. Every listing is owned by the brokerage - not the individual agent. So this agent violated every rule in the book. ... more

Sounds like a standard, "general" disclosure that applies to virtually every home out there. And I think you might be referring to "Chinese Drywall". The seller's property disclosure is similar to a "Mold Disclosure" and the "Square Footage Disclosure" and many many other types of disclosures. These are really just "CYA" (cover your A&%) documents. If a seller knows of any issues, then they "should" disclose them. (But honestly....it's hard to prove that a seller purposely covered something up). And yes, most home owners really do not know. That is why every buyer should do a home inspection. A general home inspection can cost anywhere from $250-$500. Your inspector should be able to identify a house with a potential drywall issue.

This condo is not listed for sale. It is a pre-foreclosure. The owners have received a notice of Lis Pendens which is public record. This is posted by RealtyTrac. When searching on Trulia for homes you want to look up in the right corner above the price. If the home is for sale it will say the words For Sale. They have several listing types on Trulia such as Pre-Foreclosure/Lis Pendens, For Sale, For Rent, Public Record, etc. When an owner has received a notice of Lis Pendens they could catch up on payments or they could let it to go foreclosure. It could take years for it to actually be listed for sale.

Here is the section from their deed restrictions.

E-1. BUILDING REQUIREMENTS
a. General. No Lot within the Subdivision shall be used except as solely and
exclusively for residential purposes. No Dwelling shall be erected, altered, placed, or
permitted to remain on any Lot or parcel other than a single family Dwelling not to exceed two
stories in height. An attached private garage shall provide for not less than two nor more than
three motor vehicles. No Dwelling shall be moved or transferred from any location to any Lot
or parcel within the Subdivision.
b. Construction and Square Footage. The Dwelling to be erected shall be
constructed of new and durable materials. Each Dwelling shall have a minimum of 1,600
square feet of living area, exclusive of garage, caged-in areas and porches.
c. Roof Materials. All roofs on Dwellings shall be constructed of cement tile,
baked clay pottery, shaped stone, masonry construction, or coated metal having the appearance
of any of those materials. No build-up gravel, marble chip or other type roofs shall be
permitted except over lanais/patios constructed on the rear portion of Dwellings.
E-2. USE
No Dwelling shall be occupied until the exterior of such Dwelling shall be fully
completed, including finish Lot grading.
