I agree that the best way is using a professional but some properties if they are owned by Bank of America and you can find the original owner you can contact them directly and offer to buy without it going to foreclosure first...have worked with foreclosures for the past 3 years and every bank is different, I just wanted to make sure that the question was answered to the fullest not just giving them one option....

Regarding financing, as long as your credit score and debt to income ratio falls within the lending guidelines, obtaining financing should not be a problem. In California, you are required to disclose any death or murder to prospective renters or buyers for three years after the death occurs. Regardless of the cause or the people involved.

But in Florida, under Section 689.25(1)(b), Florida Statutes, a homicide, suicide, or death that occurred on the property is not a material fact that must be disclosed in a real estate transaction.

There frequently are discrepancies in square footage in listings at different websites. The county tax records give you a square footage based on the original footprint of the home when it was built. It only gets updated if there is a construction permit pulled for purposes of remodeling. In an mls listing, the agent gives their best estimate of square footage based on measurements of interior rooms, which is a guestimate. This is the reason that just looking a price/sq ft is misleading, because many other factors can come into play affecting the price per sq ft. It is always up to the buyer to verify what the actual sq footage is, and frequently the buyer relies on the appraisal done by the bank's appraiser for this determination. It is best if you look at the tax records, have your agent look at previous listings of the home, and ask the seller why there is a discrepancy--maybe they know something that is not apparent to others (like remodeling that was done without pulling a construction permit).

They are correct Jordan, this was a bank owned waterfront property that was on the market for quite a while. The status is contingent right now, which means there is possibly a reason for a delay, buyer financing, or they may have to sell another property in order to purchase this one. Or maybe even a home inspection. What that means to you is depending on the contingency, you can submit an offer as well, or a back up offer in case this one falls through.
