Seller, we opened up escrow back June and here it is October. We have continued to keep in contact with our agent who appears to be making deals with the buyers agent which is obvious as buyers agent continues come up with ways to make us pay for repairs that were never listed the contract or counter offers. I took a trip to City Hall and according their regulations- the buyer has to make the Housing Inspection appointment and realtor has to have business license per CMC sec. 6310 (whatever that it), we actually ended up getting a lawyer who basically said ride it out because if the repairs are extensive and the buyers may back out. The length of time has passed- escrow closed Aug 14th passed. Contingency date has passed. We advised our agent of all the repairs upfront and nothing can be agreed upon. We don't want to sell the house because we do not trust our realtor. The buyers agent has not set up a inspection date. I sent an email to my agent to advise buyers agent to proceed notice several times. Does this suffice to cancel escrow? ... more

Likewise in other major European cities.. When did you see your Naples house for sale advertised in a magazine or newspaper if you didnt pay an extra fee ? Uploading details and photos to MLS is many listing agents idea of their best attempts to 'sell' a property. sitting back and twiddling thumbs until another sales agent drops lucky is the name of their 3% game.

The selling agent must work under a Broker who I understand does nothing. except he holds errors and ommissions insurance . . The agent he splits commonly 50/50. some now have different splits. 6% is a rip off. no one really works for that amount. Overall m,y opinion is that 6% is unnecessarily high and over payment for the work.

Right now Im actively seeking a good agent willing to accept a lower commission to sell a well priced easy sell home in 34105.

I suggest asking your listing agent that question. If you dont have one then read the contract you signed. There should be a section that will give you the answer. Typically under financing section. I would lean to say yes it is voided but I also dont have all the information to answer with an absolute yes. You can also have an attorney look over the contract you signed.

Your listing is with the broker of the real estate company, not the listing agent. So when your agent moves to her new company, your listing would stay with the old real estate company. You can ask that broker to release you, but I suggest reading your listing agreement carefully first, see what terms are involved with a cancellation.

Sometimes brokers are cooperative in letting listings go with the listing agent when the agent moves on (for a referral fee or percentage, of course), others can be real sticklers about the listing staying with the original brokerage.

Your agent technically cannot and should not be encouraging you to move with her, that would be a violation of most local real estate board rules regarding listings.

Talk to the broker and see what you can work out.
