You didn't "accept" the seller's counter. You put forth a new question... even if your agent had given your question in a more timely fashion... you hadn't sent an "acceptance".

In the meantime, an offer the seller was willing to accept came in.

I don't see anything either illegal, nor unethical in this practice. It's a shame that your agent didn't act more quickly.. did you ask him "why" he delayed?... but unless you were prepared (after hearing the answer to your question) to say "Okay... I'll take it".... and follow that up immediately in writing... you might still not have gotten the property.

You could write a back-up offer, just in case something goes wrong with the first offer. That's your recourse.

If it is your land ... you can remove obstacles of your choosing to allow removal of the mobile home. Since it is your land, you are required to maintain unobstructed access for the tenant.

If the current tenant leaves owing you money .... you will have to sue that tenant. How do you expect to force someone new to make good on a bad debt they had no part of?

If the lender foreclosed on the trailer ..... they usually haul it off immediately. If they ask you to keep it in place for resale ... they should have a rental agreement in place with you.

You can't charge them for any time it is caught up in the courts ... as that is against the guy the foreclosed on.

What makes owner financing appeal to many borrowers is that they will not have to give a full 20% down payment. In exchange, the lender (aka the property owner/seller) will charge 1 to 2% above conventional mortgage interest. The current mortgage rate is 3.61%. So 5% is reasonable.

If you can get a buyer to pay 20% down, then by all means go for it but many buyers will want to put less.
