I'd recommend you screen several agents to evaluate your current house and get a CMA to see the projection for how quickly you could sell your house and for what price. Make sure you ask for the worst case scenario. Assuming you have a reliable timetable for the new home being completed, I would begin marketing the old house at least 6-9 months out from when you would like to move. Yes there is demand. You are minutes from much more expensive areas with shortages of rentals. As to ease, speak with your local housing dept to get requirements. I suggest you get inspections done ahead of time to avoid being charged premium fees for rushed inspections.(also to give yourself time to address any issues) Beyond that there are many things either you or your realtor should do in order to rent such as getting an update of market,looking at your property thru prospective tenant's eyes and addressing concerns like old carpets or paint. Take pictures of every room from both directions to document condition prior to move in. Take pictures and record serial numbers of appliances (especially inside pictures showing cleanliness) for your files. There are many other areas to consider such as advertising, lease form,application credit checks and references. If you are already a seasoned landlord its all pretty easy, if not I suggest seeking out an agent with a track record and references. (yes, I do cover Monmouth Junction also) ... more

That sounds ridiculous that the landlord would do the repairs after you move in. You would think it would be done ahead of time. Also, they could be BS'ing you. If you sign a lease, make sure that ALL promised repairs are stipulated, as well as, a time frame for them to be completed. Also, I'm not sure how many BR's you have - the 2 BR go for about 1400 for the 1st floor, but anywhere up to 1600 for the 3rd floor. ... more

Your Attorney is the best person to direct you.
To my knowledge, If you have signed the Middlesex MLS standard contract of sale,part of item no. 10b-Responsibilities to cure States clearly,
"If Seller shall fail to agree to cure or correct such defects within said seven(7) calendar days period, or If any part of the dwelling is found to be located within a flood hazard area, or If the environmental condition at the property (other than radon) is incurable and is of such significance as to unreasonably endanger the health of the Buyer, the Buyer shall then have the right to void this contract by notifying the Seller in writing within Seven (7) calendar days thereafter. If Buyer shall fail to void this contract within these seven(7) calendar day period, the Buyer shall have waived his right to cancel this contract and this contract shall remain in full force, and Seller shall be under no obligation to correct or cure any of the defects set forth in the inspections"

Once your listing expires with buyer A - yes, there is a proctection clause that will protect the Broker from you selling your house to anyone that they have shown the house to on your own. As long as it is not listed with another agency.

The minute you list with Broker B.. (that can be day two after your expiration with Broker A ) and that buyer comes into that house with another agent, even a dual agent.. Broker A is not owed a commission.

While I am not an attonrney, it appears that you have an option to "opt out." However, before pursing such an option, it is always advisable to consult with an attorney.

Be aware of Realtors that may want to jump on board with you (as a well qualified buyer) in an effort to nullify the current contract in an effort to gain your business.
