Real Estate Agents are not allowed to comment on a variety of topics. The Fair Housing Act restricts the information that can be provided by a Real Estate Agent. Visiting the area and making your own determinations about what is best for you is the way to go.

Off Limit Topics Include:
• Crime Statistic (including questions about whether a neighborhood is good or bad or safe)
• Demographics
• Environmental Concerns
• Household Income
• Religion
• Schools (including questions about how good or bad the school is)

Determining to the answers to questions on any of the topics listed above is something that you would need to do on your own. It is up to the individual to make their own determination about a specific area. If a Real Estate Agent were to comment on such a thing, it could be steering which is a prohibited act.

The reason real estate agents shouldn't comment on crime is because we're not crime experts or law enforcement experts - we are liable, not only for the accuracy of the information we provide, but for the impression we leave on the client. The General Public expects us to be experts and when we comment on a topic, such as the condition of the roof or the safety of a neighborhood or the quality of the schools, we take on the position of an expert.

For us to tell someone that a neighborhood is "safe" is stupid, for us to tell them that it is "dangerous" is an invitation to spending several weeks talking to a Federal employee.

It is not in any way against the law, or an ethical violation, to comment on crime in a neighborhood. It's only stupid.

When it comes to any safety/crime related issues, it's always best to contact the local police department with all your questions, hear all there is to hear firsthand. If unfamiliar with the area do revisit more than once and at different times of day, possibly chat with locals/neighbors.

I've done my fair share of watching Oakleigh. If you have noticed, there have recently been a lot of houses being redone on Marine St. --- this is a group of guys (from what I gather) that live in Oakleigh that are looking to better the neighborhood.
