Only the first lien or senior lien wipes out subordinate liens.

Now, if the bank foreclosed 3 years ago was the first lien holder and they are the current owner of record and the HOA forecloses on the bank (owner of record) then the bank will lose ownership of the property in the new foreclosure auction.

Note: court auction properties do not convey a free and clear title.

If the HOA foreclosure is against the owner that the bank foreclosed against or a subordinate lien holder then yes it will have an impact against you as the new winning bid.

Before you bid make sure you know the name or names of those being foreclosed on by the HOA and understand your risk.

Brickell Key still provides excellent investment properties. Price are still rising in Brickell (check out my Investors Guide to Miami Real Estate 2014 http://luxlifemiamiblog.com/invest-in-Miami/

Brickell Key is a gated Island with limited opportunities to build on and excellent ocean views. Since the supply is limited the investment opportunities can be great (ofcourse depending on the unit and the price)

In which building did you buy. It always depends on the quality of the unit and the price you are asking. Normally when a good quality unit is priced at market value you wont have any issues renting it out. First of all, you will not be able to get a 90% LTV financing, unless the Condominium is in the PERS' list (There are only 2 lenders offering this type of financing in Florida). For the most part, the financing is 80% LTV, is the project is in the PERS or the Special Designation List; or 75% for an Streamlined Review (meaning, they don't have to be in the approved lists); but all of this only works for Primary and Second Home. The Neo Vertika is a fantastic building with a New York style loft feel with an industrial look but yet very chique. For the price that you can get on a rental or buying the square footage is great compared to many other buildings in Brickell. Depending on the line you can get a fantastic view of the financial district and regarding the Irish Pub it has closed down so you will not have a problem with the noise complaints.

I believe that both Tequesta 2 and Tequesta three are phenomenal as buildings in Brickell Key. Of course, Carbonell and Asia are obviously the newest buildings in Brickell Key, however, the Tequesta's have the nicest pool in my opinion since the Asia pool does not have much sun hitting directly to it, and Carbonell's pool while nice is small.

The amenities are great and even Tequesta one an older building still has excellent floor plans and layouts with good prices for the area. It is very difficult to have a Tequesta opening for a listing, rental rates are great for ROI'S, (return on your investment) regarding the 2 bed, 3 beds and up.

Also, if your commission offered is below the market price, you may not get as much traffic through the MLS posting.
