Determining the seller's authority to sell involves an investigation and a risk that most people handle with the purchase of title insurance. This transfers the risk of an unauthorized sale to the insurance company.

Another way to figure this out is to ask the seller to produce documents showing their authority to sell, which is not all that unreasonable, but which will simply duplicate what the title insurance company's work.

If you have a doubt based in fact, as opposed to being mere curious, ask your broker to document the seller's bona fides before you put your money down.

Typically, no the seller will not pay your closing costs. As the other agents have said, they may though agree to a seller's concession, but the greatest risk is if their home does not appraise at the higher value. Most sellers and their attorneys will allow it, with a clause in the contract that states if the home does not appraise including the concession, the buyer must be able to pay for their closing costs and move forward w the transaction. This way it's a win win for all and the deal stays together. I have negotiated this many times.

That may also be the case if the agent you are working with is also working as a seller's agent.
Agents are supposed to identify who they are working with "at first substantive contact" with the consumer. The form is the Agency Disclosure Form. As a buyer this is a very important document that you should save.
Is your agent working for you? Have they checked the boxes stating that they are "acting in the interest of the" "Buyer as a" "Buyer's agent"? If not, they are stating, up front, that they are not acting in your best interest.
There are agents that only represent buyers, Exclusive Buyer Agents.

No, No, No, they will not extend the tax credit past April. Why should they? Sales will begin to pick up this Spring. Once buyers come out of the woodwork they may need a fire extinguisher to hose them back. Prices have NEVER come down so much in the history of the country. Mortgage rates are also historically low. Many of the foreclosed homeowners need a place to live. If they do not have the credit to buy then other family members will step up. It will be interesting to see all of this unwinding as those bitten by the Recession start to help fuel our home sales recovery. That is my opinion anyway. I've been wrong before... yep, me, Joe Washick, WRONGO before and I'll be WRONGO again. Still, many years of decline AT SOME POINT IN TIME will begin to turn around. After all, 5 bad years is equivalent to 5% of an extraordinarily long lifetime. This Recession will go in the record books but another housing stimulus will not be necessary. THERE MAY BE ONE CAVEAT I'd like to mention. If foreclosures by record numbers still enter the market and unemployment continues growing then, in late April, ask again and we'll see if even my answer remains the same. (smile) ... more
