Everything should always be in writing, no exceptions which would avoid this. It is never recommended to list subject to finding housing which also would have avoided this. At this point you should have a clause in your sales agreement what happens to escrow when this happens. Here anyway we would turn to the clerk of courts for a hearing with a judge. Code isn't as important as safety. I would bring it up. The same way GFCI may not be in place or have been code when the home was built, but you would want to improve that as well. In Newton very little is a deal breaker as its hard to find a good home at a "fair" price and there is a lot of competition with buyers who make offers without inspections and or finance contingencies.
