With most new construction in FL, the builder/developer retains control of the HOA until a specifically stated percentage of homes have been sold, generally in the 90%+ range. At that point the HOA control gets turned over to the residents of the community, although I have noted a few where the builder still maintained at least 2 or 3 seats on the board until the community was fully built out.

You'll have to read your bylaws, but most likely yes, the developer can amend the HOA covenants to not allow rentals if the developer deems it is in the best interests of the community.

If you don't like the rule changes, you have the option of lobbying to reverse it again AFTER the homeowners have taken over control of the HOA.
