Yes, unfortunately this is true. The HOA can foreclose for non-payment of fees. I contacted a Real Estate attorney estate yesterday to get a better understanding of what is actually going on. They were very helpful and forthcoming with good information. These are new laws on the books and the HOA's are starting to use the legal system to collect fees because the banks are taking so long to complete the forecloses and the HOA's are loosing lots of money as a result. I highly recommend that you contact a real estate attorney, because the HOA can foreclose and take your property and you will be forced to move out. The HOA's know that they are not first in line for the house, but this a way of holding the bank responsible (at least someone) for the fees. Under the law, the HOA can only collect 12 month back fees for a single family home and 6 months for condo, ... more
