You might want to consult with an attorney if you have a short sale, whether you have still to present all offers to the bank even if the seller opts out...

I deal with bank owned properties all of the time. It all depends on the bank and the asset manager for the bank. I put in an offer today on a bank owned proeprty and received an answer back already. I also put in an offer on a bank owned property 2 weeks ago and have not heard back yet.

Hi Jane,

Here is a situation that many people get very confused with. If you have EMD in escrow and you choose to cancel, whether it is within your rights to or outside your rights to, both parties (buyer and seller) must mutually agree to release the EMD to one party or another by executing cancellation instructions from escrow releasing the EMD. There is never a "definite" on getting EMD back regardless of the situation. Once it is locked up in escrow, both parties must be involved to release it. So unless the seller agrees to release the EMD back to you once you cancel, your EMD money could potentially sit in escrow until it is resolved.
