There are several things you have listed here that are a little confusing. The Court (Divorce, I will presume) appointed a trustee to sell the home. The trustee at this point is the person that can answer some of the questions. The trustee now should put the house up for sale. In order for them to get an accurate market price they will need to get information from a real estate agent or appraiser. I would suspect that the trustee will us a real estate agent to list and sell the home.

Much of what you are asking is dependent on the order of the court and the trustee and should be part of your divorce decree. What did your attorney advise you about the house?

Is anyone living in the house? Does the divorce decree prohibit either of you from putting in an offer on the house? The instructions the court gave the trustee and possibly mentioned in your divorce decree hopefully covered the issue of the division of equity, if any, and what happens if a short sale is necessary.

As far as what offers (bids, as you put them) are put on the house will be determined by several factors including price, location and condition of the house to name a few.

There are still many issues that need to be answered, many of these are legal questions that you should ask your attorney. Your attorney should be able to tell you the rights the trustee has and the instructions they have been given regarding the sale of your home. Questions to ask your lawyer:
Can I sell the home? (If you are the only one on the title) What are my rights about who can buy the home and at what price, i.e. can he or I buy the house? How soon can it be put on the market? Will it be listed by a real estate agent? Do my husband or I have any say in what agent is used, if any?

Besides any restrictions by the court enforced through the appointed trustee you then have the current market to work with in the sale of the property. There is a legal clinic held in the courthouse by attorneys that volunteer that may be able to help you.

When I married the house belonged to my ex and during the marriage the HELOC was refinanced in both our names, the bank put me down as the primary and him as co-owner however the deed was never changed to reflect my name. Now that we are divorced, the decree states I can refinance within 6 months and take sole possession or he can do the same; the house is on the market and if it does not sell within 6 months we both own jointly and my name is to be on the deed. If the house sells he keeps any profit--not likely and if there is a deficit he pays it--very likely. I want to be able to sell my share of the property once my name is on deed because I have no interest in the residence and because of this debt on my credit, I can't even buy a house now. The issue comes up is how much time did the Courts allocate to sell the home in the
Present Financial market. It's not un common for Courts to allow a home to sell within 1 year.

A lot depends on whether the owners are allowed to stay in the property and keep it up
Or are asked to leave. A vacant home sells for less.

Your Lawyer can insist with the Realtor that the Divorce decree be maintained confidential.

It maybe prudent for one spouse to buy the other out for about 10%less than the last comparable.

This is about shrewd negotiation. I have seen many higher priced foreclosures sell for very low asking prices but it depends on the condition. The more repairs, the better.

There is a "203k Ready" program I would suggest could help you find the right people to help you. Most foreclosures do need at least some repairs. You will need: a Realtor, a 203k Lender, a Contractor and a HUD Consultant. Usually the HUD Consultant can put you n touch with experienced people.

It works like this:
You hire the HUD Consultant to look at the property and tell you what repairs are needed and how much they will cost. They prepare what is called a "Feasibility Report" that can accompany your offer. You then get a 203k Lender to provide what is called " automated underwriting approval" instead of the standar pre-qual letter that is required.

Your Realtor can then use that information to help "justify" your lower offer. Theprogram works very well and I can refer you to someone in your area if you like. More FHA 203k info can be found at www.203kServices.com

By packging your offer you will have the best chance for success with the right people helping you.
