With HOA dues, if a HOA isn't certified with the state, are dues actually due by homeowners?

I believe our past board forgot to renew the certification with the state for 2 and half yrs and now they are looking to raise the dues.

As a past HOA president I do hope your are going to the meetings and questioning why the dues are raising. Most HOA try to keep the dues the same as much as possible but sometimes with rising costs that is not possible. If you are thinking because they didn't renew certification (my HOA had a property manager who would have handled this - does yours because the fault would lie with them) that you won't have to pay dues be very careful HOA's have the power to put liens on your property for non-payment.

I've found some people have disagreements with HOA's and stop paying them for one reason or another. In Florida, Homeowner Associations are foreclosing on delinquent owners, evicting them after the foreclosure sale, and renting the property, to recoup their losses. It isn't advisable to stop payments to an HOA without consulting an attorney.

Do you mean "registered" with the state, William? Not being an attorney, I would ask that you research this on your own, but my 2 cents says if you closed escrow with dues for an HOA, you will likely be liable as long as the association is viable. Good Luck!

Well, William, YOU are the HOA, so if you don't pay your dues, how are you going to keep up the place? How are you going to pay for insurance and utilities and maintenance, et cetera?
