I have a home in a HOA. They have people on the board who have a land conract with the owner. Is this legal?

She is the owner of this property. We have a puppet board, because these people have a land contract with her.

It sounds like there are more than one property/units that have Land Contracts on them. Check with your Bylaws, but it sounds like this may be legal. Even if the Bylaws state otherwise, it is up to the Board to enforce the rules. If this has been allowed in the past, it may be too late to enforce them now. If the Land Contract holders now make up a majority of the board members, you may not have any choice in the matter.

Hi Alromo

You may be able to find the answer by reviewing the Master Deed Bylaws of your association.
It might address what type of ownership or interest a individual must have to be on the board.
You may also want to consult with a real estate attorney and have them review the association by-laws and give you an opinion on the legality of your the situation.
