Thank you for your question about whether or not a property is in foreclosure. The county recorder records all foreclosures and the court has to take the house after a notice of default is filed. Therefore, the court has records to let you know if a property is in foreclosure.

The best way to find out is from a local agent even though the county has records because a local agent can provide you more information about the property and its value.

You will need to read your lease and determine it that way. Most leases state that the home must be returned in substantially the same condition that existed at time of the rental with ordinary wear and tear.
