I need help! I had a final walk through today. Mind you all inspections were done previously and came out

clean. Well TODAY...there were hundreds of swarmer termites laying dead in all of the corners.My buyers want to back out (they are an older couple, using their life savings). The sellers have always aggressively treated to prevent termites, and have a current contract. Has anyone had this happen to them? How do I best protect my clients (buyers)? Is this a lost sale? Are there repercussions to them for backing out?

Back out only executed sales contract governs what takes place if buyers back out. I would make attempts have seller treat property with proof of professional services have amendment to sales contract. Appraiser would see this could decline close on home not issue loan. Not a deal breaker I would not want purchase a home unless issues are professional addressed.

I would try and negotiate a mutual agreement that the seller provides proof or treatment or conducts a new treatment. If the buyer just backs out they could be held liable. Good luck with working things out
