not affect us as far as crime in our neighborhood but it is just uncomfortable to see them hanging around. How shall I say this on my disclosures. I do not want to hide it to the prospect buyers.

You should have the agent who is representing you answer this question because it has to do with agency relationship and getting responses from other agents might interfere with that agency relationship and put everyone at risk as to errors and omissions insurance.

One thing is for sure -- if it's a fact that could influence the sale or the transaction (aka material fact), it must be disclosed. Just wording it might be tricky. Check with your agent.

If you have doubts whether or not you have to disclose a material fact, you have to disclose it. You may want to make sure if the kids you are referring to are part of a gang or have caused the gang activities. By the way, I am not an attorney. You may seek legal advice.

Felix, I would only state facts. Unless you have a police report stating that they are affiliated with a gang, I wouldn't use "gang" lightly. If they haven't committed a crime, then they are just being teenagers "hanging around". Any buyer who is looking in your neighborhood most likely wants to live there and it's up to the buyer to research any crime in the neighborhood.

As a homeowner you must disclose what you know to be a fact. If you are having some questions about disclosing you want to consider getting some professional price.

Could it just be teenages hanging out? What is prompting you to suspect gang activities?

If you know for a fact there is gang activity in your neighborhood then yes, you must disclose it. Do you know this for a fact, or do you suspect these young people may be gang members? Is there a police presence in your neighborhood? Whenever you have to wonder whether or not to disclose something it is best to just go ahead and disclose. This may have an impact on the sale of your home. Do you have to sell in this market? If not, hold on for awhile and see if the market shifts in the next year.
