How many business days prior to the closing date are sellers obligated to sign sellers documents?

Asked by Susan, Scottsdale, AZ Thu Feb 17, 2011

My closing date is Feb. 28 and the escrow officer wants us to sign tomorrow. Do they have to have their paperwork a certain number of business days before the close date?

It would depend on if the Title company is in the same city. If it's a local Title company it seems pretty early to sign. Most Title companies want the Buyers in at least 3 business days prior to the closing date. Of course there are exceptions. You might want to ask your Realtor why they want you in tomorrow. There must be a particular reason for the urgency. If it's because the Escrow Officer will be out of the office, perhaps you can get assigned another person in the office to facilitate the closing on or before the 23rd. This should give you plenty of time for the Lender to review closing papers and fund the money. Good luck!

Forgot to mention there is no 'Business days in Arizona" days are real days. By the way there is no harm in signing early. It won't close until the date agreed to.

Check with the escrow officer and ask why she needs the documents signed today. It is possible that the Buyer's Lender has some forms that require signature before they will sign off the underwriting review. There is no harm is signing early it just saves the escrow officer time on the day of closing so your sale closes on time. As I said, call the escrow officer and ask this question, you will get a much better answer than the speculative answers you will get here.

Sounds like a request from the company closing it. As a seller your documents are few and can be signed early. I have had sellers sign days before or on the day of closing. I doubt that you are obligated to sign early, but maybe AZ law says you must. Why not call the company closing and ask?

0. Seller can sign the day of closing on most cases. Nothing on the AAR contact unless it is written in.
