They can certainly put it on the market if they wish, but the dispute would probably need to be resolved before they could enter into a contract with a new buyer. You really need to consult your attorney for answers based upon the particulars of the situation.

I'm afraid more information is necessary. Are you in contract? You cannot put it back on the market while in contract.

If you are not yet in contract, yes.

If an executed contract exists, your attorney can better answer the question, therefore consider a consultation....

Are you saying your home is under contract currently, but there is a dispute? What does your REALTOR say? Different areas handle things differently. Here in CO you can have your home listed as "Active/Backup" which means it's actively listed and there's a contract on it, but they are accepting backup offers in case the first contract falls through. You should discuss this scenario with your agent and see what your options are. But you can't just accept another offer until the current one falls through.
