Are you on a sewer system or is this a septic system? If septic if the tank is not big enough per BOHA specification you have a big problem,
Check with your town to see how to proceed.

If you are a buyer considering a home with an illegal bathroom, first ask the sellers what their plan is. If they don't plan on legalizing it, they will have to take it down before the appraisal, supposing you will be financing. After closing, it will be your choice to restore it or not. Should you decide to restore it, you need to know your home insurance will not cover any damage caused by illegal electrical or plumbing work.

Are you the seller or buyer....check with your local town regarding any permit information that will lead to a certificate of occupancy.

If you've already bought them home contact the building dept and go with their guidance. They will most likely come out and look at the bathroom and tell you whether it can be legalized or not. Typically you will open a permit, have it inspected to make sure it is up to code and if not do what is necessary to get it there. Once they inspect they will issue you a Certificate of Occupancy and close the permit. It could cost you a little bit of money as well.
