we made an offer on a house, the closing is saturday. the seller is refusing to honor the contract he signed

we have paid ernest money as well as appraisal cost, not to mention the countless hours we have spent

I agree, you should contact your attorney and find out what the underlying reasons are; maybe it can be fixed quickly and you can still close.

What is your agent telling you the reason is? And do you have an attorney representing you? If yes, they should be able to provide you guidance. If no, get one that knows real estate for your state.

Why? What is their excuse? It may come down to requiring an attorney to review your contracts and threaten them with a law suit. If you know why they are balking, it may help you avoid the legal issues and allow you some other options to resolve everything. Do they want to delay? Do they want to sell to someone else for more money? Are they no longer able to buy another home due to income or health reasons?
