we are in the process of closing on a house in Stillwater, New York. We just found out the the seller didn't disclose house was in foreclosure

If the house is sold before foreclosure occurs and the morgage holder paid off, the foreclosure does not happen and should not affect you at all.

Please discuss this with your attorney.

That is a rough spot for you to be in. Are you going to be able to close prior to the schedule sale date? If the sale date is scheduled prior to your closing date your Realtor should be able to work with the bank and show them a copy of your executed contract and hopefully get a postponement approved so that you guys will still be able to buy the home.
