You can check with Southampton Town. A Lender will require a certificate of occupancy along with the title company and homeowner's insurance.
A homeowner should take care of obtaining CO's prior to listing their home for sale. If the home is going to rented, a CO is also required.

You do not have to have a C of O to purchase, but you cannot mortgage, secure title insurance, or make alterations to the property without one. If you find a property without a C of O and wish to purchase, you should consult a licensed engineer or registered architect to advise you as to what would be required in terms of time and likely cost to get the C of O prior to signing a contract. Remember, in NYS, it is very difficult to void a contract to purchase real property, so if the purchase is conditional, spell it out! Further, should you wish to rent the property, the Town will not consider granting a permit to rent unless the property has a valid C of O.

Lenders will require an updated CO at closing, and it is obtained from the Town of Southampton. There is a fee ($200-250) and it takes some time (weeks). It is important to allow for this in purchase contracts, and it is a good idea for sellers to take care of updating the CO prior to placing properties on the market for sale, if possible.
