My friend were under similar situation where she had to back out of a signed contract (not because of losing job) because the construction crew discovered an ancient bomb that was used in WWII on the construction site. My friend found out from the news about this and approached the builder, though the builder did not disclose the exact location of the bomb, it worried my friend enough that they wanted to back out. Needless to say, the builder refused to do so and pointed to the contract.........Well, things changed after my friend spent a little more than a thousand dollar (well worth it) to have an attorney send the builder a letter about this, and also tell the builder that we have network that can expose how they handled this case to the media (we do). The builder eventually refunded all the deposit back to my friend and case is closed.
I think you have a even more legitimate reason to ask for a refund, as other realtor pointed out that you won't have a job, and thus shouldn't qualified for a loan now.....Find a good real estate attorney to help you out, the small amount of money that you need to pay the attorney should be well worth it (comparing with what you'll lose)....Good Luck! God bless your family.
