Who typically pays for special assessments that are remaining on a property, the buyer or seller?

Be careful! Who pays the special assessment fees are determined by when the special assessment was levied by the municipality!

These fees can be negotiated in the offer but if they are not... There is language in the WB-11 Residential Offer To Purchase that determines who pays.

It can be negotiated either way in the Offer to Purchase, but typically it is the seller who pays such fees.

If you are using a Realtor and the State of Wisconsin WB-11 Residential Offer To Purchase, Special assessments are covered on page 8 of 9 lines 360-368. Consult your realtor about your specific situation.

If you are not using a Realtor then consult a qualified person to give you legal advice.

Typically the seller pays them as the seller has to give you a clear title void of any liens. The special assessment would be a lien sort to speak. That is usually cleared up before closing.
