Who chooses the Title company when doing a for sale by owner transaction?

All reasonable answers below- and while it is common to this area that the seller picks & pays, also keep in mind if you area moving elsewhere that other areas may not be the same.

Frequently the seller since they should be paying for your title policy. If that was not part of the agreement and you will pay for the title policy then it should be your choice. Bottom line, most buyers and sellers have no experience with title companies, so it will be up to the agents to recommend best options.

Make this part of your negotiations.

Generally, the buyer may choose the title company --- but if the seller has already provided a preliminary title report from a title company, he may ask to use that title company for the closing.

It's negotiable....

There is no set rule on who chooses the title company. It is all based upon the negotiated contract. I will tell you that on the FAR/BAR Purchase Agreement (used by licensed Realtors), the contract states that whomever selects the title company gets to pay for the Owner's Policy and closing charges, but this is not written in stone. It is all part of the negotiations.

Who is paying for title? That is the person that chooses the title company.

Usually the buyer does, but either can choose the company that closes the deal or you can each get a lawyer. It's all up to you both to agree on it.
