I am under contract to purchase a home that has some termite damage. Some repairs were done after the termites were discovered in 2001. My WDO inspector found additional damage last week. The sellers disclosure, which was signed in Jan 2008 did indicate that the home had been treated and repaired in 2001, but later goes on to say that there have been no reports or inspections done in the last five years. The problem I have is that my WDO company was at this same property in 2007 for another buyer's inspection. So there was a report done, and I have to assume that the sellers did get a copy. I have asked the WDO company to release the report to me, but they seem little hesitant. So does this non-disclosure give me an "out" if they don't want to repair the damage to my satisfaction?
