The offer to purchase I made on a florida home states the buyer has until Feb 24 to sign and return .

he signed and dated it Feb 25, does that mean I no longer have to honor this offer. I am looking for a way to cancel this deal and the seller is not being very cooperative.

By rights you should really consult with a contract or Real Estate Attorney. However, if your contract states that the buyer (...and I am not sure if you are actually the seller or buyer) must return a signed reply by Feb. 24th ...but it was dated a day later. Its over. - Real Estate documents are by nature and law, time sensitive. I am assuming you are doing a FSBO transaction, otherwise your agent should give you some good advice.

You don't indicate on which form the offer was made. It should have included a specific time frame in which the seller had to reply and your right to cancel if the time to respond condition is not timely met. I would send a follow-up that clearly indicates that the reply condition was not met and that you no longer wish to purchase. Send this notice special delivery with a return receipt requested. You may need to consult a real estate attorney.

Contracts in Florida can change from each individual Broker. In NE Florida we all pretty much use the same purchase agreement and "THE TIME OF ACCEPTANCE" Clearly states the offer must be communicated in writing before a certain date and time, or the offer will terminate. If you have a binder deposit involved it could get sticky, I highly recommend you consult a Florida attorney to review your contract. If you used a Realtor here to handle your negotiation, shame on him for not helping you out.
