THE CORRECT RECORDING SHOULD OF BEEN A NON-VALUABLE CONSIDERATION. CAN I CANCEL ESCROW AND GET A FULL REFUND OF THE MONEY THAT'S IN ESCROW?

Brian, if there is a cloud on the title and you still want the home, then the title company can fix the cloud on the title. If on the other hand you do not wish to proceed with the purchase of this home, then having a defect on the title may be your "out". Seek competent, legal advice from a real estate attorney to decide what your rights are. I hope you're represented by a Buyer's Agent who is there to help you through the home buying process.
