Short sale deadline is in 4 days and seller was denied hafa credit.

Asked by David Farkasch, Homer Glen, IL Sun Feb 3, 2013

The 6 month deadline to close on the house I made an offer on is in 4 days. My end is all set and my lawyer is trying to set up closing but the seller is upset because he was denied his hafa credit and pretty sure he will not go to closing without that credit. Can he refuse to go to closing legally and what happens if he refuses to go?

David,

You should discuss this with your lawyer. Whether it's legal or not depends on the wording on your contract. Likely it's not a breach of contract for the seller to back out. Even if it is, there's not much you can do. You can try to initiate a suit for specific performance, but that gets very expensive very quickly.
