The previous homeowner didn't pay his HOA fees for seven years and it has totalled up to $38,000 just from not paying and bringing in an attorney.

Have your Realtor put a clause in the Offer that the delinquent HOA dues will not be paid by the Buyer:
Talk to your Realtor about it; that what he's there for.

Typically the seller will pay for any back HOA dues. The only time this isn't the case is in some short sales where the lender will not allow it and makes the buyer pay for it.
