Is there a time limit for sellers to refund the 'deposit' back to the buyers if the deal fell through within?

Asked by Natalie, La Mesa, CA Mon Feb 25, 2008

the '17 days' where no contingencies were lifted? Can we serve a 'notice to perform' after a certain amount of time?

Natalie: Your deposit is probably in the hands of the Escrow Company. After the 17 days period, your deposit might be in jeopardy but you give me the impression that the Seller is the one that is not performing? I imagine that you have an agent. Your agent or his/her broker would be able to check your purchase contract and resolve the problem right away.
