Is it recommended to have a real estate lawyer when buying a house in Killeen, Texas?

My husband and I are PCSing to Ft. Hood. We found a house we really like and are ready to put an offer on if everything works out with the inspection, but we have heard from family that we should get a real estate lawyer to help. Is this necessary or recommended when buying in Texas, even if we already have a relator?

In most cases you will have an attorney drafting the documents and examining the title which is the typical role of an attorney in a real estate transaction. If you are purchasing a home with conventional financing on a TREC One to Four family contract you will typically not have an attorney involved.

If there are complex issues, use of non standard forms, or items contracted like the purchase of a business and a property you would want to have special documents drafted and they can only be drafted by the principals, you or them, or an attorney.

Most people don't use attorney's when buying residential real estate in Texas , although you are more than welcome to do so if you feel that you need one. All our Purchase Contract forms for properties with 4 or less units are standard, promulgated forms issued by the Texas Real Estate Commission and are widely used by all local Board of Realtors across the State. Your Realtor should be able to explain this to you.

You will want to have a title company handle the closing. This will ensure that the title transfers to you correctly and will also be able to provide title insurance in case there are issues.

I would talk to your Realtor about the title companies and other options in your area.
